2 face charges in alleged gun purchase attempts
PENNSDALE – In separate cases, two men face charges for providing false information on an Alcohol, Tobacco Firearms form when they attempted to purchase a handgun at Gander Mountain, 66 Mall Parkway, on March 2, according to the Muncy Township police.
Robert Alan West, 54, of 110 Lafayette St., Jersey Shore, and Charles Willis Brown Jr., 52, of Monroeton, each have been charged with attempted illegal sale of a firearm – a felony – and making an unsworn falsification to authorities.
Both men answered “no” on an ATF form when asked if they ever had been convicted of a felony or any other crime in which they were incarcerated for more than a year, police said.
When a Gander Mountain employee did a background check on West and Brown through the state’s Instant Check system, it revealed they neither man was allowed to purchase a firearm because of “prior criminal history,” police said.
“West has been convicted of several offenses that carried a prison sentence that exceeded a year,” police said. Also on the form, he answered “no,” to the question of whether he had ever been convicted of a misdemeanor offense related to domestic violence. Police allege that answer also was incorrect.
Brown’s application to purchase a firearm was rejected “due to a driving under the influence of intoxicants arrest and sentencing,” police said.
West and Brown were arraigned before District Judge Jon E. Kemp and released on $40,000 bail each.
